TERMS AND CONDITIONS

Leasing policies at Piche Rent a Car El Salvador. ®

Any dispute arising from this Contract will be resolved in accordance with the laws in force in the Republic of El Salvador and subject to the jurisdiction of the competent courts of the country.

  • Refund: We reserve the right not to issue refunds.

    Definitions. “Agreement” means all the terms and conditions of the rental agreement (“Rental Agreement”) and any additional documents that you sign or that we provide to you at the time of rental, whether electronically or otherwise. “Renter” means each person who signs this Agreement, each Authorized Driver, and any person or organization billed by us at your or the Renter’s direction. “We,” “our,” or “us” means [Car Rental Company]. “Authorized Driver” means (a) the Renter; (b) any additional drivers listed by us in this Agreement; and (c) any other person defined as an “authorized driver” under applicable law. Each Authorized Driver must have a valid and current driver’s license and be between 21 and 65 years of age (unless otherwise required by applicable law). “Vehicle” means the car or truck identified in this Agreement and any vehicle we substitute for it, as well as all its tires, tools, accessories, equipment, keys, and documents provided inside the vehicle at the time of rental. “Physical Damage” means damage to or loss of the Vehicle resulting from (but not limited to) collision, theft, vandalism, natural disasters, civil unrest, hail, flood, fire, or other loss not caused by collision. “Loss of Use” means the loss of our ability to use the Vehicle for our purposes due to damage or loss, including, without limitation, its use for rental, display for rental and/or sale, opportunity for improvement or sale, or transportation of employees. “Diminished Value” means the difference between the fair market value of the Vehicle before the damage or loss and its value after repairs, calculated by a third-party appraisal obtained by or on our behalf. “Fees” means the fees and charges incurred under this Agreement. “Vehicle License Fee”, “Vehicle Licensing”, “Vehicle License Ownership Tax”, “Vehicle License Cost Recovery Fee” or “Vehicle Tax” means a license cost recovery fee based on our estimated daily average per vehicle of the total annual licensing, titling and registration costs, or as defined by applicable law.

  • Rent; Compensation; Personal Property; Guarantees.

    Only Authorized Drivers may use the Vehicle. Authorized Drivers include only the persons named in the Rental Agreement. We may repossess the Vehicle at your expense and without prior notice if the Vehicle is abandoned or used in violation of the law or this Agreement. You agree to indemnify, defend, and hold us harmless from and against any and all judgments, claims, liabilities, costs, and attorneys' fees incurred by us that result from or arise out of this rental and the use of the Vehicle or Optional Equipment (defined below). You release us, our agents, and employees from any and all claims for loss of or damage to your personal property or the property of another person that we have received, handled, or stored, or that has been left or transported in the Vehicle, in any service vehicle, or at our offices. We make no express, implied, or apparent warranties on the Vehicle, including any warranty of merchantability or fitness for a particular purpose. In no event will we be liable to you for any indirect, special, or consequential damages directly or indirectly related to any alleged breach of this Agreement.

  • Vehicle Condition and Return.

    The rental constitutes a "bailment," meaning that the use of the Vehicle is for the benefit of the Renter. The Vehicle must be returned to the Airport or other location we specify on the date and time indicated and in the same condition in which it was received, except for normal wear and tear. Our determination of the Vehicle's condition is subject to a final inspection for any damage that may be identified after the return, whether the vehicle is checked in by an employee or not, and regardless of whether such damage is immediately visible or concealed. If the Vehicle is returned outside of business hours, the Renter's responsibility continues until the final inspection is completed. To extend the rental, the Renter must contact us before the return date. Any servicing or parts replacement during the rental period requires prior approval. The Renter is responsible for checking and maintaining fluid levels and returning the Vehicle with at least the same amount of fuel.

  • Liability for Damages or Loss.

    Regardless of fault, you are responsible for all damage, loss, or theft of the Vehicle during the rental period for any reason. Under applicable law, your liability includes: (a) physical damage caused by collisions, weather, vandalism, road conditions, natural disasters, or other causes; (b) if we determine it is a total loss, the fair market value less the salvage value; (c) if repairable: (A) the difference in value before and after the damage; or (B) the actual or estimated cost of repair plus Diminished Value; (d) Loss of Use, calculated by multiplying the daily rate by the actual or estimated days of repair or replacement; (e) an administrative fee based on the damage.

  • Prohibited Uses.

    The vehicle may NOT be used for:


    (a) Any unauthorized person or person with a suspended license;


    (b) Under the influence of alcohol or drugs;


    (c) Providing false information when obtaining the vehicle;


    (d) Illegal purposes;


    (e) Transport of persons or goods for hire;


    (f) To tow or push;


    (g) Speed races or trials;


    (h) To teach driving;


    (i) Transporting hazardous materials;


    (j) Leaving El Salvador without authorization;


    (k) Transporting more passengers than available seatbelts;


    (l) Carrying children without legally approved child safety seats;


    (m) Odometer manipulation;


    (n) Operate the vehicle if it is reasonable to think that it may damage it;


    (o) Poorly secured cargo;


    (p) Operate manual transmission without experience;


    (q) Voluntary or reckless acts;


    (r) Using or reading electronic messages while driving.




    Smoking is prohibited. Any prohibited use invalidates any coverage product (where permitted by law).

  • Safe.

    If you purchase the Insurance, according to the terms of the Contract, we waive our right to charge you in full or in part for physical damage to the Vehicle, including Loss of Use and administrative fees.

  • Third-Party Liability; Accident/Incident Management.

    You are responsible for any injury, damage, or loss you cause to yourself or others. We are not liable for such damages unless required by law or you purchase coverage. You are responsible for knowing your coverage. You must: (a) report any damage or accident to us and the police as soon as it is safe to do so; (b) complete our incident report; (c) provide us with any legal documents related to the incident.

  • Payments; Charges.

    You authorize us to hold a reasonable amount on your card as a reservation. You will be responsible for all charges: optional products, fuel, taxes, recovery services, legal fees, cleaning, towing, late return or return to another location fees, parts replacement, etc. All charges are subject to review and final audit.

  • Infractions and Other Charges.

    You are responsible for all fines, violations, and penalties incurred during the rental period. You authorize us to release your information to the authorities and to collect the amounts paid plus administrative fees.

  • Personal Information; Communications.

    We may disclose personal information to law enforcement or third parties to enforce this Agreement. We may contact you by phone, SMS, or email, including automated calls or prerecorded messages.

  • Miscellaneous.

    No term may be modified without a document signed by us. This Contract is the entire agreement. It does not constitute a waiver of any rights if we fail to exercise them. You waive all recourse against criminal charges arising from violations of this contract. We release you from liability for consequential, special, or punitive damages to the extent permitted by law. This Contract is governed by the law of the place where the rental commences. If any clause is held to be invalid, the remaining clauses shall remain in full force and effect.
